Abstract
(en) In February 2024, the Union legislator chose Frankfurt am Main as the seat of the new Anti-Money Laundering Authority (AMLA), using a novel procedure that involved a joint vote by representatives of the European Parliament and the Council. Previously, the seats of EU agencies were selected by representatives of Member States’ governments in accordance with Article 341 TFEU. This had to change following three judgments in July 2022, when the Court of Justice ruled that intergovernmental seat decisions had no legally binding force. Following these judgments, the creation of AMLA was the first time the Union legislator had to choose the seat of an EU agency with the ordinary legislative procedure. This chapter examines pre-AMLA agency seat selection, the Court of Justice’s main findings, and the new AMLA procedure to determine whether it will serve as a blueprint for future seat selections.
