(en) The Treaty of Lisbon has fleshed out the European principle of democracy and rendered it applicable to European administration. While the legitimation of national administration constitutes a core area of constitutional law in Germany, the Court of Justice of the European Union (CJEU) has not yet developed a comprehensive body of case law regarding the legitimation of administration. This article develops a concept of European administration and, in light of the Union’s dual legitimation, examines various mechanisms for conveying democratic legitimacy. Even in the absence of a comprehensive doctrinal framework, the CJEU ensures the legitimation of European administration through the use of primary law principles and its own jurisprudence.
