Abstract
This article examines the legal implications of introducing a fifth EU Treaty Freedom for research, innovation, and education, as proposed by Enrico Letta, with particular regard to strengthening the right of access to knowledge. It argues that, while access to knowledge in education and research is already indirectly protected under the European Convention on Human Rights and the Charter of Fundamental Rights of the European Union(notably through freedom of expression, academic freedom, and the freedom of the arts and sciences), such protection remains fragmented. By constitutionalising a fifth Freedom within the internal market framework, the EU could both reinforce judicial protection of access to knowledge through the Treaty's application in free movement cases and stimulate legislative and political action to promote a European Knowledge Commons
