Chronique de la justice climatique en Europe (2015-2022)
(en) Europe has been experiencing since 2015 the rise of a “climate” jurisprudence resulting from the unprecedented judicial activity of associations, individuals and local authorities. Even though national judges respond in an unequal manner, one observes the emergence of common elements in the way lawsuits are constructed and in the content of judicial decisions. The purpose of this column, the first in an annual series, is to highlight these common elements around three axes: (I) actors ( the courts, the profile of the applicants and defendants), (II) fundamental questions being raised though such lawsuits, and (III) the main sources of law being mobilized, including the invocation of human rights.
