Abstract
It is accepted that public procurement is used to serve more ambitious political objectives than simply satisfying collective needs. In view of the current crises that are affecting the old continent’s economy, the Commission is proposing to introduce a European preference in public procurement law. Legally, it should be remembered that public procurement in the EU is guided by the principles of equal treatment, prohibition of discrimination on grounds of nationality and transparency. This article looks at an alternative to this European preference, which also aims to strengthen the EU economy. Local preference appears useful because of the beneficial effects it has on satisfying collective needs, the efficiency of the internal market and the transformation of the economy towards a sustainable, fair and diversified model. Where it may run counter to the above principles, the practice should be regulated.
