Abstract
This paper examines the role that Article 10(3) of the TEU could play as a judicial catalyser for EU citizens to combat democratic backsliding in their Member States. Amid rising populism and illiberalism, the paper proposes that citizens leverage Article 10(3) TEU through strategic legal mobilization and transformative constitutionalism to safeguard their democratic rights and reinforce the EU’s foundational values. It argues that empowering citizens in this way not only counters undemocratic national actions but also strengthens participatory democracy at EU level. The analysis concludes that a coordinated grassroots approach, with strong national court support, could amplify the impact of Article 10(3) TEU as a democratic safeguard, thus fostering a resilient democratic structure within the EU.
