Abstract
The thesis focuses on the CILFIT judgment of 1982 adopted by the Court of Justice, as well as on the application and interpretation of Union law by national courts of last resort. After having underlined the theoretical deficiencies of this judgment, and analyzing the jurisdictional practice, I formulate a proposal of iure ferenda which tends to restore the balance between the uniformity of Union law, on the one hand, and the interpretative margin national courts, on the other.
