- (en) According to the Belgian Council of State any deterioration of one constitutive characteristic of a special area of conservation that is not in a good condition is not allowed under Article 6, §3, of the Habitats Directive. In those circumstances there is definitely no room to apply de minimis-thresholds to allow certain plans or projects with a (presumed) limited effect. This strict assessment of the Belgian Council of State seems in line with the precautionary principle and the effet utile approach applied by the European Court of Justice in its case-law on the Habitats Directive.
