The obligation to extradite or prosecute those accused of committing international crimes is limited in the treaties. It only applies to certain crimes. No such obligation exists for core international crimes such as genocide, crimes against humanity and war crimes other than grave breaches of international humanitarian law and war crimes committed in non-international armed conflicts. This thesis aims to identify the gaps in treaty law regarding the obligation to extradite or prosecute in the context of international crimes and to identify elements that could fill these gaps.
