Abstract
(en) The central question addressed in the commented ruling revolved around the appropriate course of action for a decision concerning a return that, if carried out, could potentially subject the individual involved to severe pain, thereby jeopardizing the principle of human dignity. In this context, the Court of Justice clarified its interpretation of the threshold of severity required to qualify as a violation of the prohibition of inhuman and degrading treatment enshrined in Article 4 of the Charter of Fundamental Rights of the European Union. Alongside this issue, fundamental questions regarding the protection of human rights by the European Union were also discussed, particularly concerning the scope of application of the Charter and its relationship with the standards set by the European Convention on Human Rights. This commentary aims to provide a critical analysis of the responses given and the questions raised by this ruling.
