The thesis tends to establish that the problems contained in the case law of the European Court of Justice regarding the principle of legal certainty can be explained by four logics (fiducary, cartesian, political and subjective) that have developed over the centuries in western legal thinking. It proposes to give priority to the fiduciary one over the cartesian one and to the subjective one over the political one.
