Abstract
(en) In its judgment of 10 July 2019, the Court of Justice of the European Union clarified the scope of the precontractual obligation to provide information on “distance” and “off-premises” contracts within the meaning of Directive 2011/83 on consumer rights. More specifically, the Court focused on the means of communication that must be communicated by the professional to the consumer prior to the conclusion of such contracts. This commentary provides an opportunity to examine, step by step, the Court’s reasoning, whose primary objective was to ensure a fair balance between a high level of consumer protection and the competitiveness of enterprises. Moreover, the commented judgment is put into perspective with Directive 2000/31 on electronic commerce and new Directive 2019/61, known as the Omnibus Directive.
