Access to services of general economic interest is a key concept in European legislation and case law. However, the recognition of this access as a fundamental right by Article 36 of the Charter of Fundamental Rights of the European Union does not seem to have had very satisfactory legal effect so far. The actual or potential uses of this provision are addressed successively: the declinations of the right of access to SGEI in Community policies; the principle of equality and the standstill effect linked to the right of access; and the tool for interpreting and monitoring the legality of Community acts or national measures.
