Abstract
(en) This article discusses some developments in secularism to illustrate the blurring of the border between public law, the law of authority, and private law, the law of freedom. Secularism is imposed on the State in order to protect the freedom and equality of citizens. Relying on the freedom of enterprise, private companies declare themselves neutral in order to restrict the religious freedom of their staff. Public schools, on the other hand, rely on freedom of education, traditionally reserved for private schools, in order to curb the religious freedom of teachers and pupils without ant legal backing, in disregard of the constitutional principle of legality.
