- Abstract
- This contribution constitutes the Belgian report published in the European Tort Law Yearbook 2017, edited by the European Centre of Tort and Insurance Law together with the Institute for European Tort Law of the Austrian Academy of Science and the University of Graz. The Yearbook provides an overview of the latest developments in tort law in Europe (important court decisions, new legislation and literature overview). The Belgian study points out especially : (1) the new legislation concerning damages claims in the case of infringements of competition law and (2) the Act of 8 June 2017 accelerating judicial proceedings concerning compensation when the damaging event falls within the scope of a rule providing a no-fault liability regime. As far as case-law is concerned, one points out four decisions of Belgian Supreme Courts (Constitutional Court and Cour de cassation) delivered in 2017 (on the following topics: state liability in case of negligence of the supreme court, Damage to Lawns and Flower Beds Caused by Big Game, compensation for damage resulting from medical care and compensation in kind).
