In a global conference on the role of the judiciary in enhancing effective environmental adjudication, new conceptual developments need to be addressed that broaden the range of possible avenues for advancing the effectiveness of environmental law. Among those conceptual developments, the objective of a ‘high level of environmental protection’ is worth consideration. A concept that is deeply enshrined into the European Union Treaties but that, for a long time, remained in a sort of shadow zone. It has now stepped up into the limelight of the European case-law scene, by virtue of various – not always coherent – developments in which the Court of Justice of the European Union plays a paramount role.
