Abstract
Recent CESCR decisions in the field of housing have gained considerable relevance in Spain. Can we identify any judicial developments predicting a better compliance with CESCR decisions on the right to housing? This chapter presents an analytical summary of recent CESCR decisions regarding the right to housing in Spain, as well as an overview of two recent judgments of the Spanish Supreme Court allowing us to predict a possible shift in its approach to this issue. The chapter focuses on the Committee’s decision in the case of Ben Djazia et al. and on forced evictions.
