- This presentation explores how the rules on platforms liability in the EU, enshrined in the e-Commerce Directive, the European Court of Justice case law and the Digital Services Act (DSA) can shed lights on the recent discussion surrounding section 230 of the Online Decency Act in the United States. Furthermore, the EU with the DSA proposes a more hands-on approach to content regulation on online platforms through transparency obligations and first steps towards co-regulation, notably by allowing access to platforms’ data to vetted researchers. We explore how the US legal framework on online platform could inspire itself from the recent developments at EU level.
