- This article studies the degree of fit of the Polish gender regime with the gender regime of the European Union (EU). It tackles the double methodological challenge of applying the Western concept of “gender regime” to an Eastern European country and to a “non-state” such as the European Union. The main finding is that the Polish gender regime did not undergo any decisive changes during the country’s recent transition to democracy. Post-1989 governments only reinforced the familialism that characterized Polish social policies even during communist years. Similar in their perception of women as both workers and mothers and the degree of social rights individualization, the EU and Polish gender regimes differ with regard to their respective approaches of gender-specific “protective” labor legislation. Additionally, EU soft and hard law has not been successful in challenging the strong familialism of the Polish gender regime, notably with regard to insufficient state support for non-familial childcare.
