- Abstract
- The organisation of children's lodging when parents break up. - This article deals with a reflection upon the organization of children's lodging when parents break up. On one hand the article will dwell on the child's best interest upon which all the courts decisions related to the lodging organization rest upon. This decision-making concerning the child's best interest evolved since last century, and it enabled a greater balance between the two parents dealing with that issue. On the second hand, we will study the different types of lodging which vary from the main home (which often is attributed to the mother) to an alternate lodging (fifty-fifty for the child's care between the two parents). Can we have one single typical lodging model ? What are its limits ? What are the implications for the children ? We shall attempt to answer these questions. We shall also deal with a particular situation that is to say the persistence of conflict between the two parents; this extreme form of hatred is what is defined as the parental alienation syndrome (PAS).
