La désobéissance civile écologique au prisme du droit international et européen des droits humains : approche conservatrice, libérale, démocratique ou radicale ?
(en) This article uses several instruments of international law (the International Covenant on Civil and Political Rights and the Aarhus Convention on Access to Information, Public Participation in Decision-Making and Access to Justice in Environmental Matters), as well as European human rights (the European Convention on Human Rights of the Council of Europe), to examine the protection of ecological civil disobedience through the lens of human rights. It reveals the balancing act performed by national and supranational judges and the tensions that emerge from their decisions. It also highlights the spectrum of approaches to ecological civil disobedience reflected in international and European human rights law instruments, as well as how these instruments are implemented by the relevant bodies.
