Choses défectueuses et inexécution contractuelle : conditions et effets de l'imputabilité de l'inexécution contractuelle causée par une chose défectueuse
(en) The thesis examines and evaluates how Belgian law addresses situations in which the non-performance of a contractual obligation is due to the defective nature of a thing. It is structured around several questions:
- How is a defect in a thing defined?
- Under what conditions may contractual non-performance be attributed to the debtor when it results from a defect?
- Where applicable, what are the consequences of such attribution?
- Is the treatment of contractual non-performance caused by a defective thing uniform? Should it be?
- Is this treatment appropriate?
In the first part of the thesis, these questions are applied to situations where a defective thing is delivered to a contracting party. In the second part, the focus is on cases where a defective thing is used in the performance of an obligation.
The thesis lies at the intersection of the law of contractual obligations, the law of special contracts, and non-contractual liability. The analysis covers both the former Civil Code and Books 5, 6, and the future Book 7 of the Civil Code.
