- Abstract
- (en) Drawing on Giacomo Delledonne’s “Economic Growth in the Legal Order” as its starting point, this article puts the history of constitutional thought under the light of an historical sociology of legal knowledge. Focussing on post-war West-Germany, I question the way constitutional thought dealt with economic growth and propose a genealogical approach to the emergence of the ecological paradigm. Using "statist" legal scholars such as Ernst Forsthoff and Ernst-Wolfgang Böckenförde, I show how constitutional discourse succeeded in defining itself as above and equidistant to the conflict between two opposite paradigms: the ecological one and the one based on economic growth.
