Abstract
(en) From the secondary effects of solidarity based on articles 1205 to 1207 of the Civil Code, doctrine and case law have developed the theory of reciprocal representation of joint and several debtors, from which other procedural effects have been deduced, in terms of res judicata and remedies. Recent decisions have provided an opportunity to examine the relevance of these secondary effects, which are hardly compatible with various fundamental concepts of modern private judicial law.
