Abstract
The international legal norms currently governing the protection of displaced persons are a legacy of the responses provided to problems that occurred in Europe in the 1950s. This dissertation acknowledges that the protection problems encountered by today's displaced persons differ from the ones in the 1950s and that regionally developed legal norms such as the 1969 OAU Refugee Convention in Africa and the 2001 European Directive relating to Temporary Protection in Europe do not completely and adequately address the changes in today's displaced persons' protection needs. It also acknowledges that the core concepts used for the protection of displaced persons (movement, person and frontier) have significantly evolved, especially with the development of international, regional and national legal norms aiming at better protecting human beings without discrimination. Drawing from these facts and the practice developed by international protection agencies like the UNHCR and the ICRC during the past 50 years in Europe, Africa, Asia and Latin America, this dissertation proposes new definitions of the concepts of displaced persons and protection. Other suggestions include new international institutional arrangements aiming at better protecting displaced persons, regardless of whether they have crossed an international border. The study is sustained by the author's practical experience who has been working with displaced persons for several years and in various regions. The dissertation is divided in 4 parts. A preliminary chapter shows the need's changes in term of protection for the displaced persons since the 1950s. Part 2 of the study examines the notion of displaced person and its legal foundations. The notion of protection follows. In this third part, UNHCR and ICRC's activities in various situations of displacement of persons are studied. The last part is dedicated to the proposals aiming at better protecting the displaced persons.
