Abstract
(en) The law of 23 March 2019 concerning the organisation of prison services and the status of prison staff is the fourth prison law adopted in Belgium. Innovative in various respects, it aims to strengthen the protection of the fundamental rights of prisoners by guaranteeing the probity of prison staff and the continuity of the prison service through various measures. A trade union representative of prison officers brought an action for annulment of the law before the Constitutional Court, considering, among other things, that the legislation disproportionately infringed on the right of prison officers to strike. The Belgian Constitutional Court, in a ruling No. 107/2021 of 15 July 2021, rejected this appeal. The contribution offers an analysis of this decision.
