- Abstract
- After reviewing the basic principles of the information phase in Belgian criminal procedure, this paper focuses on the evolution of interactions between the police and the public prosecutor over the course of this phase. Starting from the study of a new procedural instrument, the "autonomous police treatment", it emphasizes the questions of authority and direction in the pre-trial investigation phase and the relational difficulties between the two actors. The growing pivotal role of the police in this pre-trial stage is also highlighted.
