Abstract
(en) The law does not have a monopoly on incorporating standards from other sectors, but its central and superior roles have been challenged. Hence the question : what place and role does the law now retain ? First, the author addresses the issues from an observational and factual standpoint, reflecting on confrontations between normative mechanisms in the fight to achieve dominance in the “greater cultural whole” (hegemony, compartmentalization, or domination combined with collaboration). Second, the author adopts a normative approach and reviews the functions and aims pursued by the law each time we decide to use it in support of our coveted values of freedom, egality, solidarity, and justice.
