Abstract
The paper examines the main argumentative grounds mobilized in the literature on deliberative assemblies drawn by lot. The proponents of these assemblies often present them as the source of a fairer and more democratic deliberation, either for their inclusive or for their representative virtues, without it always being clear what representativeness and inclusiveness are meant. The contribution starts by differentiating the claims of inclusiveness for deliberative assemblies. The supposedly more egalitarian property of sortition, as inclusiveness understood as cognitive diversity, are being questioned. The paper explores the capacity of deliberative assemblies to respond to the deliberative requirement of inclusion of all points of view. Secondly, it addresses the representativeness claimed for deliberative assemblies, which is mainly descriptive. We argue that this type of representation is not without its problems in terms of the democratic legitimacy of the representatives. More generally, the paper seeks to highlight the lack of solid theoretical foundations for legitimizing the deliberative assemblies, in regard to the theories of political representation and democratic deliberation.
