- The recovery plan NextGenerationEU, and its main operational channel, the Recovery and Resilience Facility set up by Regulation No. 2021/241, constitute a decisive instrument for the future of the EU. The environmental transition being one of the founding pillars of the initiative, it may arguably have a substantial impact on the greening of the EU economy. The Facility indeed includes mechanisms designed to ensure that it can serve the transition and support climate and environmental sustainability. This presentation provides an in-depth assessment of these relatively understudied green conditionalities. As They contribute to the rise of a new form of environmental governance “through spending”, which presents distinctive features from other, more traditional forms of environmental governance (‘command-and-control’ or pricing regulation), and comes with opportunities and risks regarding the Rule of Law.
