Abstract
Among the new conceptual developments that broaden the range of possible avenues for advancing the effectiveness of environmental law, the objective of a ‘high level of environmental protection’, as far as it governs the environmental competence of the European Union (EU), is certainly worth consideration. The notion is deeply enshrined into the EU Treaties but, for a long time, remained in a sort of shadow zone. It is only quite recently that it stepped up into the limelight of the European case-law scene, by virtue of various – not always coherent – developments in which the Court of Justice of the European Union (CJEU) plays a paramount role.
