- The Nagoya Protocol has often been presented as a tool for environmental justice as its objective is the fair and equitable sharing of benefits arising from the utilisation of genetic resources and associated traditional knowledge. Without refuting this idea, this presentation discussed two problems with such a conception: the difficulty of a commonly shared connotation for these concepts and the possible conflicts with the way in which intellectual property rights are currently being used for products derived from genetic resources and traditional knowledge.
