(fr) Technological progress, and in particular the processing of personal data, which feeds on it, represents an economic and societal value, which is the object of competing desires. Therefore the European legislator has worked to update the provisions relating to the protection of personal data by replacing Directive 95/46 with the General Data Protection Regulation, or "GDPR". Since its entry into force, the GDPR has strengthened the powers of the supervisory authorities and introduced, and the traditional criminal sanctions and fines imposed by the national régular courts. This contribution examines the legal framework of sanctions established by data protection legislation, including the GDPR, focusing on both, the regime of administrative sanctions and the regime of criminal sanctions, with a particular focus on the qualification of administrative fines and their consequences.
