- (en) The screening of migrants at the borders of the European Union and the legal fiction of non-entry: sovereignty reconsidered The Pact on Migration and Asylum introduces a new "screening" procedure at the external borders for third-country nationals who do not meet the conditions for entry into the European Union. Central to the screening procedure is the legal fiction of non-entry, which claim that the arrival of migrants only occurs once they have been legally approved to enter the state, regardless of their physical presence in the territory. Drawing from a typology distinguishing between traditional, post-sovereignist and post-traditionalist approaches to sovereignty, this article analyses the effects of the fiction of non-entry for the relationship between the concepts of territory and sovereignty. It shows that the fiction of non-entry is part of a wider movement of disconnection between the concepts of territory and sovereignty, which can be better understand by a post-traditionalist approach to sovereignty.
