- At the beginning of 2010, while the Belgian authorities were trying to form a government after the elections which had been marked by tensions between linguistic communities, Ph. Van Meerbeeck and H. Kieboom proposed a public reflection on amnesty as a factor of reconciliation. This article shows the problematic issues involved by such a stance from a critical and philosophical point of view. By first underlining the legal and philosophical contradictions of amnesty and then highlighting the social pathologies which its implementation can bring about, the authors develop the hypothesis that amnesty renders null true reconciliation and hinders the rightful task of memory. The latter can escape neither the demands of justice nor the portion of the irreconcilable which forgiveness can never neutralize.
