This contribution constitutes the Belgian report published in the European Tort Law Yearbook 2016, edited by the European Centre of Tort and Insurance Law together with the Institute for European Tort Law of the Austrian Academy of Science and the University of Graz. The Yearbook provides an overview of the latest developments in tort law in Europe (important court decisions, new legislation and literature overview). The Belgian study points out especially about one decision of the Council of State on compensatory indemnity, one decision of the Constitutional Court on compensation of moral damage suffered by an environmental association and five decisions of the Cour de cassation delivered in 2016 (on wrongful life action and wrongful pregnancy action, on the violation of the right to be forgotten and on the liability of the guardian of a ruined building).
