The thesis examines whether due account has been paid of the interests of the different interested parties when intervening in a well-defined area, i.e. the possibility for undertakings to promote foods with nutrition and health claims (e.g. ‘low fat’, ‘contributes to the normal functioning of the heart’). Both kinds of claims can be made by operators in commercial communications as a means to attract more consumers, but their use is subject to restrictions. The thesis will not only examine how the use of claims in the EU is restricted but also whether the limitations in force are not overly restrictive or, on the contrary, do not go far enough. In doing so, alternative measures which could help consumers make choices in line with their long term interest in good health will be considered.
